I confess I never thought I would see this, especially from the 9th U S Circuit. By a vote of 2-1 a three-judge panel has declared that “the right to bear arms includes the right to carry an operable firearm outside the home for the lawful purpose of self-defense.”
The ruling was from a 2009 lawsuit filed by Edward Perula who challenged San Diego County which denied him a gun permit. The ruling cited the SCOTUS decision in the Heller case which struck down a Washington DC gun ban.
This decision is also likely to end up in front of SCOTUS as other courts in other locations have given different rulings on the same general subject.
